This Personal Data Processing, Payment, and Refund Policy Agreement ("Agreement") governs the use of Study in Kazakhstan (the "Website" or "Platform"), operated by Private Company Education in Kazakhstan Ltd., a legal entity duly organized and operating in accordance with the legislation of the Republic of Kazakhstan (hereinafter referred to as the "Operator").
This Agreement establishes the legal framework governing:
Scope
- collection and processing of personal data;
- use of the Platform;
- payment procedures;
- refund conditions;
- rights and obligations of Users and the Operator.
By accessing, registering on, submitting applications through, uploading documents to, making payments on, or otherwise using the Platform, the User confirms that they have read, understood, and fully accepted the terms of this Agreement without reservations.
1. SUBJECT OF THE AGREEMENT
1.1. The Operator provides Users with access to the Platform for the purpose of:
- submitting applications to educational institutions;
- uploading and processing educational and identification documents;
- receiving admission decisions, including offers, conditional offers, or rejections;
- obtaining consulting and admission-related services;
- making online payments for available services.
1.2. The Operator shall process personal data strictly within the limits necessary for provision of Services and compliance with applicable legal obligations.
1.3. This Agreement constitutes a legally binding public offer in accordance with the civil legislation of the Republic of Kazakhstan.
Acceptance of this Agreement by the User constitutes full and unconditional accession thereto.
2. PERSONAL DATA PROCESSING
2.1. The Operator shall process personal data in accordance with:
- the legislation of the Republic of Kazakhstan;
- the Law of the Republic of Kazakhstan "On Personal Data and Their Protection";
- applicable international standards and regulations where required.
2.2. The Operator may collect and process the following categories of personal data:
- full name;
- gender;
- nationality and citizenship;
- date and place of birth;
- passport and identification data;
- residential address;
- contact information, including telephone number and email address;
- educational documents and academic records;
- certificates, diplomas, recommendation letters, and examination results;
- financial and payment information;
- uploaded documents and application materials;
- technical information, including IP address, browser type, operating system, cookies, and session data.
2.3. Personal data shall be processed for the following purposes:
- identification and authentication of Users;
- provision and administration of Services;
- submission of applications to educational institutions;
- communication with universities and partner organizations;
- verification and assessment of documents;
- payment processing;
- technical support;
- fraud prevention;
- compliance with legal obligations;
- improvement and development of Platform functionality.
2.4. The User hereby grants informed, specific, unconditional, and unambiguous consent to the collection, storage, use, transfer, and other processing of personal data for the purposes specified herein.
2.5. The Operator shall take necessary legal, organizational, and technical measures to ensure protection of personal data against unauthorized access, destruction, modification, blocking, copying, dissemination, and other unlawful actions.
2.6. The Operator shall not be liable for disclosure of personal data resulting from:
- actions of third parties beyond reasonable control of the Operator;
- cyberattacks or illegal actions of third parties;
- negligence or fault of the User, including transfer of login credentials to third parties.
3. TRANSFER OF PERSONAL DATA
3.1. The User acknowledges and agrees that personal data may be transferred to:
- partner universities and educational institutions;
- foreign educational organizations;
- payment service providers and banking institutions;
- governmental authorities where required by applicable law;
- technical service providers acting on behalf of the Operator.
3.2. Due to the international nature of educational admissions, personal data may be transferred outside the Republic of Kazakhstan.
By accepting this Agreement, the User expressly consents to cross-border transfer and processing of personal data.
3.3. The Operator undertakes to ensure that recipients of personal data maintain confidentiality obligations and implement reasonable protection measures.
4. USER RIGHTS AND OBLIGATIONS
4.1. The User has the right to:
- access personal data;
- request correction or updating of inaccurate information;
- withdraw consent to personal data processing where permitted by law;
- request deletion or blocking of personal data in cases established by applicable legislation.
4.2. The User undertakes:
- to provide accurate, complete, and up-to-date information;
- not to upload forged, false, or misleading documents;
- to maintain confidentiality of login credentials;
- to comply with this Agreement and applicable laws.
4.3. The User bears sole responsibility for accuracy and legality of submitted information and documents.
5. PAYMENT TERMS
5.1. Payment for Services shall be made through payment methods available on the Platform, including bank cards and electronic payment systems.
5.2. Payments are processed through third-party payment systems compliant with applicable banking security standards.
5.3. The Operator does not store complete bank card information.
5.4. The User confirms that all payment information provided is lawful, accurate, and belongs to the User or is used on lawful grounds.
5.5. The Operator shall not be liable for:
- refusal of payment authorization by financial institutions;
- interruptions or failures of payment systems;
- losses resulting from incorrect payment information provided by the User.
6. REFUND POLICY
6.1. Unless otherwise provided by mandatory provisions of applicable law, payments made for Services are deemed non-refundable upon commencement of Service provision.
6.2. Refund requests may be considered exclusively in the following cases:
- duplicate payment;
- technical error during payment processing;
- inability of the Operator to provide paid Services due to the Operator's fault.
6.3. Refunds shall not be granted in the following cases, including but not limited to:
- rejection by universities or educational institutions;
- refusal of visa issuance;
- withdrawal of application by the User;
- provision of inaccurate, incomplete, or false information;
- failure by the User to comply with deadlines or requirements established by universities or the Operator.
6.4. Refund requests shall be submitted in writing to: Email: info@studyinkz.kz
6.5. The Operator reserves the right to request additional documents and information necessary for review of the refund request.
6.6. Refund review period may constitute up to fourteen (14) business days from the date of receipt of all necessary information.
6.7. The final decision regarding refund eligibility shall be made by the Operator in accordance with this Agreement and applicable legislation.
7. INTELLECTUAL PROPERTY
7.1. All intellectual property rights related to the Platform, including software, design, content, databases, logos, trademarks, and materials, belong to the Operator or respective right holders.
7.2. Any unauthorized copying, distribution, modification, or use of Platform materials is prohibited unless expressly permitted by the Operator.
8. LIMITATION OF LIABILITY
8.1. The Platform and Services are provided on an "as is" and "as available" basis.
8.2. The Operator does not guarantee:
- admission to any educational institution;
- receipt of scholarship, visa, or financial aid;
- uninterrupted or error-free operation of the Platform.
8.3. The Operator shall not be liable for indirect, incidental, consequential, or reputational damages arising from use of the Platform or Services.
9. FORCE MAJEURE
9.1. The Operator shall not be liable for failure or improper performance of obligations resulting from force majeure circumstances, including but not limited to:
- natural disasters;
- war;
- terrorism;
- governmental restrictions;
- internet or communication failures;
- cyberattacks;
- actions of state authorities.
10. GOVERNING LAW AND DISPUTE RESOLUTION
10.1. This Agreement shall be governed by and construed in accordance with the legislation of the Republic of Kazakhstan.
10.2. Any disputes arising out of or in connection with this Agreement shall be resolved through negotiations.
10.3. If no agreement is reached, disputes shall be subject to resolution in judicial authorities of the Republic of Kazakhstan in accordance with applicable jurisdiction rules.
11. FINAL PROVISIONS
11.1. The Operator reserves the right to amend this Agreement at any time without prior notice.
11.2. Amendments enter into force from the moment of publication on the Platform unless otherwise specified.
11.3. Continued use of the Platform following publication of amendments constitutes acceptance thereof by the User.
